The present document (Terms and Conditions) lays down the conditions for the sales made between people wishing to make a purchase from the Vinotek website http://www.vinotek.hu, hereinafter referred to as “the Customer“, and VINOTEK.HU Kft., whose registered office is located at 18. Albán utca, Budapest – 1163, Hungary, Tax Id number: 29044267-2-42, EU tax number: HU29044267, registered in the Registry Court of Budapest under number 01-09-380187, hereinafter referred to as “Vinotek“. You can contact the company at the indicated address, as well as on the telephone +36 30 439 5447 or by sending an e-mail to the address info@vinotek.hu Vinotek is subject to the law in the country of its headquarters, which is Hungary, and to the European Union’s legislation.
Vinotek carries out the provision of this service in accordance with the following terms, applicable exclusively to the service offered on and through the website ‘www.vinotek.hu’ (hereinafter ‘the Website’). These conditions apply exclusively to non-trading individuals. Once you have read these Terms and Conditions, it is considered to be an agreement. Using the website also implies full agreement with these Terms and Conditions.
1. Description of the Service
Vinotek offers a retail sales service of products related to alcoholic beverages (mainly wines) on the Website.
Therefore, although access to the Website is free and some of its products are suitable for purchase even by people under age, Vinotek excludes people who do not have full capacity to contract or do not have full age or legal age for the purchase or consumption of alcoholic beverages.
The Website is suitable for the commercialisation of its products only to final consumers (non-trading individuals) in Austria, Germany. It also means that Vinotek.hu Kft. can issue invoices only to private persons.
2. The product defined by the contract
The wine and other alcoholic beverages about that the Website provides key information (such as winemaker, variety, region of origin, alcohol content, etc.) and / or labels (such as “bio”, “volcanic” etc.) for the consumer at the time of selecting and placing the order. The information on the marketed products is not exhaustive and has been provided by manufacturers and suppliers. Therefore, Vinotek.hu Kft. cannot assume any responsibility for any inaccuracies in this information, beyond that which may correspond to it in terms of consumer matters. In any case, Vinotek.hu Kft. undertakes to remove or correct any incorrect information it becomes aware of or that it has been notified as incorrect.
In any case, and without prejudice to the different mechanisms that Vinotek and third parties make available for the best resolution of any possible incidents that may arise, consumers are informed that the European Commission provides a free online dispute resolution platform, which is available at: http://ec.europa.eu/consumers/odr/. Without prejudice to their rights, consumers may, where appropriate, submit their complaints via the online dispute resolution platform.
3. Prices
All product prices are given in Euros inclusive of all taxes, but do not include delivery charges (see dedicated paragraph about Delivery fees). Vinotek reserves the right to modify its prices at any time without prior notice, for instance during sales periods. The products are invoiced according to the prices in effect at the time the order is completed. The ordered products remain the property of Vinotek until full receipt of the payment. Payments must be made in full in one installment.
4. Ordering steps
Orders can be processed on the www.vinotek.hu website for delivery to the following countries: Austria, Germany.
The order occurs in a few steps, which include choosing the product and quantity, filling in client information (such as name, delivery address etc.), choosing a delivery option and a payment method, and validating the order. During this process, the client is asked to confirm that he read and accepted the present Terms and Conditions. Thus, the validation of the order is considered as a definitive acceptance of the product price, description, and Terms and Conditions.
Following registration, you can log in to the site with your e-mail address and password. However, registration is not mandatory to place an order.
Delivery dates may vary depending on the delivery address and the product availability. Products with “on backorder” status are delivered within 10-12 days.
Finally check the given data and click on the “Place order” button.
Our system will automatically notify you confirming your order via the email address you provided. Your order will be registered with the order number that you can find in the confirmation.
The language of the whole process is English.
All payments are processed in Euros.
Vinotek reserves the right to cancel or refuse any orders from a customer with whom there is a dispute relating to the payment of a previous order or who appears to present some form of risk.
Vinotek commits to deliver the selected items until the stock is empty. In case one product is out of stock, Vinotek will inform the customer about the expected delivery date or refund all amounts paid by the client within 30 days.
Vinotek reserves the right to withdraw any products from this website at any time and/or remove or edit any materials or content on this website. Whilst Vinotek will make its best efforts to always process all the orders, there may be exceptional circumstances which mean that Vinotek may need to refuse to process an order after we have sent you an order confirmation, which we reserve the right to do at any time, at our sole discretion. We will not be liable to you or any other third party by the reason of our withdrawing any product from this website, whether it has been sold or not, removing or editing any materials or contents on this website or for refusing to process or accept an order after we have sent you the order confirmation.
5. Payment and fraud protection
Customers may pay for their purchases with a debit/credit card (Visa, AmEx or Mastercard) or via Sofort or via Giropay or via direct bank transfer. All payments are processed in Euros.
Vinotek reserves the right to verify the personal information given by the customer and to adopt any measures deemed necessary to ensure that the person whose bank account is being debited is the same person who placed the order. This is to prevent any fraudulent payments. This verification may take the form of a request for proof of identity and/or address and/or bank documents. If the customer fails to respond to such a request within two days of the request made by Vinotek, the order in question will be automatically cancelled, with no option to make a subsequent complaint. Vinotek is also entitled to directly cancel an order that presents one or more risk factors of fraudulent bank card use.
6. Restrictions regarding the use of the products and/or services
We can only deliver orders of products containing alcohol to people who are legally allowed to purchase and / or consume alcohol. Although access to the website is free and some of its products are suitable for purchase even by people under age, the company excludes people who do not have full capacity to contract or do not have full age or legal age for the purchase or consumption of alcoholic beverages.
The trade name, trademarks, logo, products, photographs and services contained on this website, both proprietary and of third-party companies, as well as denominations of origin and geographical indications and these Terms of Conditions, are protected by law.
The contents of the website are aimed for customers’ personal use only. Any other use (commercial or otherwise) made of the information contained on the website is prohibited.
The Vinotek.hu Kft. reserves the right to take legal action against users who violate or infringe the rights over databases and/or intellectual and industrial property, where proprietary or of third parties.
7. Delivery
a. DPD classic delivery
Deliveries are handled by Vinotek in the following countries: Austria, Germany.
Vinotek aims to provide a quick delivery service (contracted with DPD), but it is subject to general country transportation structures. Should the Customer place the order on weekdays till noon, deliveries are expected to be processed within 3 – 5 working days if the selected products are in stock. You can check delivery details in the DPD parcel tracking system. This time frame may slightly vary within one country depending on the area, such as rural or isolated areas. The delivery time may be longer if the selected products are out of stock or on backorder, in these cases the Customer will be informed about the expected delivery date as soon as possible after placing the order. Placing the order in the webshop is considered as an acceptance of the Terms and Conditions of DPD. The DPD Terms and Conditions document is available on www.dpd.com.

c. New home delivery time and address, failure of delivery:
The day before delivery, the recipient can make one change to the delivery date, as indicated in the notification. Parcels sent after 6 April 2020 all have an individual PIN code for recipient identification. When the parcel arrives, just tell the courier the PIN code instead of signing. Look for the PIN code on the delivery notification (email or text).
DPD will attempt to make the delivery again at the new delivery time and / or address chosen by the Customer. In case DPD cannot get in touch with the Customer, and / or the Customer doesn’t choose a new time / address of delivery, our contract will terminate. The purchase price will be transferred back to the bank account, the details of which have been provided by you. The delivery fee won’t be paid back.
8. Terms of cancellation, returns, refunds
We take full responsibility for your order until the handing over of the product. If you rescind from your order because of faulty delivery or damage that occurs during the delivery, Vinotek will pay back the already paid costs to the Customer. If the customer accepts the parcel, he has 3 days to notify to Vinotek any damages in the goods received. After 3 days, we cannot accept any complaints regarding potential damage. If the items which have been refused by the customer are proven to be effectively damaged or misproduced those will be changed within 14 working days at our own expense or all amounts paid by the client will be fully refunded. This refund will be processed within a maximum of 14 days. Right of withdrawal
The customer has the right to withdraw from this contract without giving any reason within a period of fourteen days from the receipt of the product with the exception that the nature of the ordered and delivered product does not permit its return, or in case the product is perishable. To exercise the right of withdrawal, you must notify us of your decision to withdraw from this contract by means of an unambiguous declaration by email (info@vinotek.hu). To comply with the withdrawal period, you need to do is to send your written communication concerning the right of withdrawal before the withdrawal period expires. As a reference, please provide us with the order number you received in the notification email. In this case, Vinotek is obliged to return the value of the undamaged, complete, unopened good(s) within a maximum of fourteen days from the day it’s being returned. The costs incurred in returning the product due to carrying out the right of rescission should be paid by the Customer.
Effects of withdrawal
The Customer must return the item without undue delay and, in any event, no later than fourteen days after you have told us of your decision to withdraw from this contract. This period is considered to have been complied with if you return the item before the end of the fourteen-day period. Customer will pay for the cost of returning the item.
Your liability is incurred if there is any depreciation in value of the item caused by any handling other than that is necessary to establish the nature and characteristics of the item.
Exclusion of withdrawal right
You cannot exercise your right of withdrawal from the contract in the case that the product cannot be sent back after having been opened following receipt due to health, safety and hygienic reasons.
Refunds
If you cancel the existing contract, we will refund all the payments received from you (with the exeption of the delivery fee), without delay or the latest within 14 days upon receiving your cancellation statement without undue delay and, in any case, no later than fourteen days from the day we are informed of your decision to withdraw from this contract. We may defer the refund until we have received the item or until you have provided proof of shipment of the item, whichever occurs first. We will process the refund using the same means of payment which you used for the original transaction.
In the event of receiving a return package the content of which does not comply with the return request or the items of which do not comply with the return conditions mentioned above, Vinotek reserves the right to recover any debts from the Customer.
9. Guarantees
Exclusively in the event that the customer is a consumer, we acknowledge the right to full conformity of the products with the contractual commitments undertaken.
All products displayed on the vinotek.hu website are subject to the legal guarantee as described in the Hungarian Civil Code. The customer is expected to refuse the parcel in case he estimates that it is damaged during delivery, so that the parcel will be sent back to Vinotek. If the customer accepts the parcel, he has 3 days to notify to Vinotek any damages in the goods received, via e-mail (info@vinotek.hu) or by sending a paper letter with proof of postage to the following address: Albán utca 18., Budapest 1163, Hungary. After the 3 days delay, the parcel is considered as accepted and cannot be subject to any demand regarding potential damage. If the items which have been refused by the customer are proven to be effectively damaged or misproduced, those will be changed within 14 working days at our own expense or all amounts paid by the client will be fully refunded. This refund will be processed within a maximum of 14 days.
Vinotek cannot be considered as responsible for misuse of the products bought.
10. Conditions of payment
The method of payment can be selected at the time of the order. You can pay for your order by secure online connection using Sofort or Giropay or cards accepted by the system:

In the case of these cards, the issuing bank of the card declares whether it authorizes them for use on the internet. For information, please turn to the bank that issued your card.
In order to ensure that the credit card information you provide for carrying out the transaction is handled securely, Vinotek does not keep the given credit card number – neither before, during or after carrying out the transaction, nor on its computers or anywhere else.
The process of shopping and the bank card payment transaction happens in two completely separated systems, that is: select the products and complete the order on the www.vinotek.hu, the bank card transaction takes place on a secure website operated by Stripe. Under no circumstances will Vinotek learn about your credit card information, nor will Stripe receive the personal details (name, address, phone number, e-mail, etc.) you provided upon registration with Vinotek.hu. The webshop in no way has the opportunity to acquire the data of your card or the account behind it, including its number and expiration date.
b. What you should pay attention to at the time of purchase?

- Make sure that no unauthorized persons can get hold of your card data at any time.
- Use a browser that supports the option necessary for TLS security.
c. Steps of payment
- You select the product on the page of the webshop, the amount of which you wish to pay for.
- After this, you can choose the type of payment – bank transfer, Sofort, Giropay or bank card.
- In case of choosing the bank card type, the payment happens in the Stripe TLS secure system. You have to provide your card data (card number, name, expiry date, cvc code). After providing card data, you can initiate the transaction by clicking on “Place order” button.
- In case you choose the Sofort or Giropay option, it’s integrated in the Stripe TLS secure system. With Sofort or Giropay, the customer pays via online banking. Using the existing online banking credentials, the the transfer is performed here without prior registration. If the transaction is completed, you will be redirected to www.vinotek.hu website.
- Following the payment, you receive confirmation about the result of placing the order. In case you wish to learn more about the result of the transaction, or in the case of a failure to execute it, the reasons and details for it, please contact your bank.
Based on the referring paragraph of the Hungarian Civil Code Vinotek maintains the right of ownership of the product being sold until the full payment of the whole purchase price has been completed.
12. Liability and limitation of responsibility
Vinotek has an obligation only to use its best endeavours throughout all the stages regarding accessing the site, the ordering process, delivery, customer service or after-sales.Vinotek.hu Kft. cannot be held liable for any problems, any damage or inconveniences inherent to abnormal functioning of third parties involved in the technical process of the website service, specifically a disruption of services, failures in the telecommunications networks, in the services provided by Internet service providers, in collapses and cuts in telephone lines, errors in the validation programme, difficulties to receive communications due to third-party anti-spam filters, an external intrusion or computer viruses or for any event considered to be force majeure, as established by case law..
Vinotek.hu Kft. will not be liable under any circumstances and for any reason for the loss of data transmitted incorrectly, nor for those transmitted after the deadline or those whose transmission has been prevented or hindered by technical filtering systems by e-mail or management software providers.
Vinotek may not be held liable for a Customer’s misuse and / or intensive use of products. Vinotek may not be held liable for the return of a competitor’s product and / or a product not sold on vinotek.hu. It is the responsibility of the Customer to return the correct item. Consequently, Vinotek will not refund any item returned to Vinotek in error.
13. Intellectual and Industrial Property
Both the website and all the contents derived from it are protected by Intellectual Property laws. In this regard and in accordance with the provisions of the intellectual property code, only private use is authorised, subject to different, even more restrictive provisions of the intellectual property code. They may not be the object of exploitation, reproduction, distribution, modification, public disclosure, transfer or transformation. Access to this website does not grant users any right or ownership over the intellectual property rights of the contents on this website. Any reproduction, in whole or in part, of the vinotek.hu website is strictly forbidden without prior agreement.
Vinotek.hu Kft. welcomes any unsolicited submission of testimonials and other opinions, considerations and comments regarding the products or services offered by Vinotek.hu Kft. either on the website or on other platforms or channels. Such information may be added to the website (or other channels), guaranteeing at all times the recognition of the authorship and privacy of the authors. Therefore in order to comply with current legislation and the technical characteristics of the medium, the materials submitted may be subject to modifications. By submitting such contributions, their authors waive any economic right or other right over them, but may request their withdrawal at any time.
The content of the website may be downloaded to the user’s device, provided that it is done for private use and without any commercial purpose. Therefore, the user may not exploit, reproduce, distribute, modify, publicly disclose, transfer, transform or use the content of this website for public or commercial purposes.
